I've sent it off to the local pc specialist to figure out if they can find what's wrong and if not I'll see if it's covered under warranty with amazon, we'll see what happens over the next week.

I went in to BIOS and switched it to 3.0 but when i booted it still said 4.0 on GPU-Z, in any case it made no difference to gameplay. Did you watch that recording?
