Problems right from Day 1? Can't you just send it back to get a refund? That'd be the simplest solution - and avoid a series of possible headaches - if FBM has the same policies as ebay does..? Because I've no idea if you're stuck with this thing or not.
I do not know where you got these from, but 3D Mark's Timespy averages for both of these are around 17700 and 5900 respectively, using the site's search mode.
Run through the usual troubleshooting steps:
1)Provide the make and model of the current power supply, and how long it's been in service. The upper end RTX 30 series gpus are picky about power supply quality.
Ex: Please don't post '750w psu'. 'Corsair RM750X' is more detailed; people viewing the thread can actually look the latter up, but not the former.
2)Use Display Driver Uninstaller to uninstall the current driver and then get the latest update through Nvidia's website, if you haven't done so already.
3)Monitor max gpu thermals under load. Gpu core, hot spot, and memory junction. Either HWINFO or Gpu-Z's sensor tab will show this. Both apps can also provide Reasons for Performance Limits - there's always at least one Reason.
4)Gpu-Z can also display the vbios version on its general tab - check that one too. TechPowerUp has a nice archive of vbios files. See if the current one is listed here:

Now, TPU requires users to voluntarily 'donate' their vbios to the collection via Gpu-Z's Validate function. So if you don't see the current vbios on their list, it doesn't necessarily mean it's not legit.
