3d mark GPU problems

Hey i tried running diablo 3 but my framerates were terrible so i decided to benchmark 3Dmark firestrike on that I had 20 FPS then on the second graphics test it crashed and I got the error

Unexpected error running tests.
Workload Single init returned error message: DXGI call IDXGISwapChain::SetFullscreenState failed [-2005270494]:

The requested functionality is not supported by the device or the driver.

DXGI_ERROR_NOT_CURRENTLY_AVAILABLE

anyone know why this is?

Could be another program running in the background conflicting with 3dMark.
