6 months used gtx 970 without box and receipt VS BRAND new GIGABYTE GEFORCE GTX 1050ti Windforce oc g1 with one year warranty

I am planning to buy a new GPU. There are two options.

1. Six-month used gtx 970 without box and accessories and without receipt, but never used for mining.

2. BRAND new GIGABYTE GEFORCE GTX 1050ti Windforce oc g1 with one year warranty.

I both are available for same price. Which one should I get?

970 is a much more powerful card.
is the performance advantage worth the risk associated with getting used HW ? it's up to you and no one else can tell what you should or shouldn't do.
