CORSAIR VENGEANCE 5600MHZ CL36

I bought the 9070xt on day one and since then I get a driver timeout in every game after 2-4 minutes, this is everything in my system at stock. I've tried turning off XMP, reinstalling windows, using DDU to fresh install Adrenalin software and driver only and closing all software in the background, nothing works, event viewer doesn't even give me a reason or acknowledge the driver crash.
The only constant I've noticed is that if I manually tell the card to run clocks around 3050MHz, it runs absolutely fine, as soon as I let it go above to say, 3080Mhz or higher (at stock it pushes 3100 - 3200Mhz) it will crash every time. Is this some kind of driver or vbios issue? I'm not losing any performance, infact running around 3050Mhz + my stable memory OC I get above stock performance in my games so I'm not losing anything here, just seems a strange issue for a card to be unstable at stock. Any info appreciated thank you.
