i emailed sapphire last night and had a responce this morning, im pleased to say i havent been screwed 😀 this is what i sent and thier reply

You don't have to worry. The P/N-Number you have sent does not belong to
a Radeon 9800 Pro 128 MB 128 bit graphic card.

102-A07521-01-at and SN A040600037255 i have a small oem box with NO
over-size 128bit sticker in fact it has no stickers and nowhere to be
seen
on the box that its either 128bit or 256bit.
