I've built a pc and sold it in craiglist for $320 with the following specs

amd a4-3400
4gb of ram
500 gb hd
Ubuntu 13.00

The guy one week after he purchase my custom built, he called me accusing me of selling him a pirated pc because i did not provided him with a ubuntu serial key.
I tried to explain this ignorant, ubuntu is a free OS and there is no such serial key, if he doesnt like it then puechase a legit copy of Windows.
Today, a sheriff officer knock my door to drop a letter to my surprise the guy is suing for scamming him supposly for not providing legit serial key.

Every time i sell a custom pc i write a number on bottom of pc for record of the system specs when it was sold and print out the system spec saying this was the pc status when it was sold, has no warranty and have the customer SIGN, and always secretly video record my self and the customer explaining the specs of the pc and the OS its running and end the deal "I dont give warranty for the pc, are you ok with the pc specs and the OS its running?" he said "its, ok".

Should I really worry about??

I don't know about the legality of "secretly recording" your customer but as far as an Ubuntu serial number you can't provide what doesn't exist. I suppose you could make one up and tell him to find where to register it. that would be good for a laugh.

No, you have absolutely nothing to worry about.

There's no possible way that you could be sued for not providing a "serial key" for a product that doesn't have one... especially when the operating system is free.

What he's trying to do is screw small business owners by taking them to court for absolutely ridiculous things; he's hoping that you're going to fold and settle out of court instead of paying legal fees.

The one potential problem is if the Ubuntu installation had the capability to play dvd, mp3 and other restricted formats... and you didn't pay for a license to include them in the os. Even though the Ubuntu U.S. repository makes those readily available, it is still technically illegal to install them without first obtaining a license. Still, you should tell the guy to eat your shorts.

Rick first off in some states like mas if you don't tell people your filming them you can be sued. Your better of to all was make a bill of sales. A warranty card or sheet and have the customer sign and date it.
For the lawsuit you have two options. One go online to where you bought the software and show there no number needed there or with the os vendor. Did you give the customer a restore cd or a copy of the Iso or anything if the drive crashed he could get the software himself without paying for it again.my shop I use a third party disk making company I make 100 Oem disk with our company logo on them.make you look like a pro when there a white cd that says restore cd on it. The other option you have to kill the lawsuit is call the sherif back that served you and say the customer was told there no Oem needed and no I not a cheat..have the sherif know you return the guys money if the pc undamaged. Right now you have 30 days to file a motion where the guy filed the small claims act to file a rebuttals. If you don't do anything the judge will find in his favor.
