For example, pcpartpicker.com comments that
"Warning: The Asus PRIME X570-P ATX AM4 Motherboard supports the AMD Ryzen 7 5800X3D 3.4 GHz 8-Core Processor with BIOS version 4021. If the motherboard is using an older BIOS version, upgrading the BIOS will be necessary to support the CPU."

Are they still shipping with older BIOS's?

The question comes down to what BIOS is actually shipped with the motherboard. Personally I'd advise on investing on a motherboard that has the option to flash the BIOS via a button and a USB drive. You could also look into a B550 chipset motherboard.

Motherboard's typically ship with the latest BIOS available at the time of manufacture and the 5800X3d was launched over a year ago so they're most likely shipping with one today. But the problem is the pipeline is long and retailers don't all turn over their inventory fast so there's always a possibility to get a board that was manufactured a while ago and with an older BIOS.

If you don't like updating BIOS's then buy from a seller who'll update it for you before sale.
