I kept getting driver issues, like not wanting to install, in the end it eventually did,
overclocking following tested clocks http://www.hardocp.com/article/2014/11/03/asus_gtx_970_strix_directcu_ii_video_card_review/3

even putting the memory in stock clock settings, I would get stutters in graphic like missing frames, 1 sec I would be in one place another sec I would be in another place, watching videos on youtube or the benchmark software would seem to have audio out of sync with video and it would also skip some frames it looks, I can't esplain it, if I run the card on stock clocks every thing seems to run smoothly.

can any one explain why this might be happening to me?
maybe since windows 10 is so new and I'm probably missing some drivers/updates?

update:
I was moving my mouse around in circles slowly with gpu on stock clocks and I notice the pointer disappear for a sec, pretty much once in every rotation, this is annoying, the same happens in World of Tanks.

Solution
Do you have the latest BIOS? also do you have a different PSU you could try? Is DRAM running at it spec? And what is the model #(s) of the DRAM...

On the Bios I looked in Gigabyte's website I didn't find a new one, I have the 2013 version, I'll keep looking, but I did go to Asus website they had a Bios update for the GPU, lol have no idea how that one works, but it didn't change anything on my Bios, it probably added some new graphics coding or something, after that I stopped noticing the stutter in graphics.

I have a couple older PSUs, 1 of them for sure does not have an 8 pin plug it was made before 6 pins came out, and the other one might have it not sure, or could just have a 6 pin, but it's an off brand or no brand, this Corsair seems to run well, if I start noticing the stutter again I'll look for the other PSU, I have it in my storage closet.

The other thing I noticed was my CPU cooler was dirty, and I was recently overclocking my CPU to 4.8 GHZ, but when I was getting all these issues I stopped overclocking it, but it was still getting the stutter but not as bad, I was just messing around with the clocks again and benching again once the screen went black, second time it just froze, after that I took out the cooler, clean it out, and put some fresh thermal paste. I was still getting the stutter until I got that update from ASUS, so now I'm noticing with AMD overdrive utility that my CPU when it's in idle the temp is mid 45ish to high 50s, but when I'm benchmarking it showing under 50c, I will run World of Tanks again while monitoring the utility for temps, and update tomorrow.

The Ram's model # is PC3-10700 CMLGX3M2A1600C10 low profile, and it should be running at a little over 800mhz, now I see it at 669.6, I guess when I dropped the CPU core to 3500 I didn't notice that I had dropped the ram as well, I will change that and see if that's causing any issues when it's running at max, or maybe it's because it's in idle?
again I will update on this tomorrow.

Thanks for pointing out those things.

Yeah I guess that Asus Bios did help, no more stutters, my CPU is simply not very good for games that are more CPU heavy then GPU like World of Tanks, I will eventually build another PC with a new intel CPU with liquid cooling in the near future.
And my ram was not on profile1 in Bios that's why it was running slow.

Thanks again for pointing me on the right direction, hopefully my CPU will last a few months longer.

Actually I think I'm going to try this first, the next model up - the AMD 8350FX very good reviews on that one, and only 170 bucks with free game, just gotta make sure I got liquid cooling if I wanna OC it to 5ghz, or I'll fry it like I did the one I got.

I just got my Asus Strix back and I was right it was the card that had issues, this one didn't have any problems installing the latest drivers and does not have any hick ups nor crashes.
