Are torrents illegal?

My friend said that you can't get in trouble for downloading torrents from the pirate bay etc. because when you download the game you don't accept any agreements with the publisher. Is this true. Would the publisher come after you anyway?

ALSO, IS USING A PROXY WHILE DOWNLOADING SAFER?

Downloading any software you do not have a license to use is blatantly illegal. There is nothing illegal about torrents themselves, just the content they tend to contain.
