Question Asus H97-Pro Looses Bios Settings After Disconnect Power

I have an Asus H97-Pro motherboard with an i7 4790k at stock settings, when I disconnect the power from the power supply and wait a couple of minutes the Bios settings are reset. I have the latest Bios version 2906, I've tried re-seating the CMOS chip but no good, I've unsoldered the battery holder and put it back in, still no good, I've tested that the 3 volt button battery is getting power to the CMOS legs and it is but they are all not the same voltage and one is earthed, the CMOS chip has 8 legs, I've updated the Bios version a couple of times. I've checked to make sure the jumper to clear CMOS is not shorting and its installed in the correct pins and I've checked to see if the jumper is good with a multi meter. If I shut down the PC but keep it connected to power the Bios is fine I'm thinking a bad CMOS chip dose this seem likely?

does POST mention any failure message why uefi loaded default values?
if no message, does your date and time changes during this reset?
