Batman Arkham Knight Fps lock and graphics settings problem

So I have the CPY version of the game,
and this are the problems I have:

1)The game runs on 30FPS with low/high settings cant get above that

2)After changing The graphics settings in the game manu,they reset back to low settings after restarting the game

3)I can't find the "BmSystemSettings.ini" file nowhere.

Easy fix. buy the game.
