Best CPU for gaming locked?

What is the best CPU in the i5 series for gaming that CANNOT be OC. Buying a GTX 970 soon.

Processor: Only overclockable which gains you 2-3 fps in games. I'll suggest not to overclock, do when your warranty becomes void.
Video Card: The GTX 970 is a better choice over R9 380.

The R9 380 is NO match for an GTX970 even if you OC it. An i5 4440 with 970 will out perform a 4690K with R9 380.
