Broken seal GPU

Hi,
i just received a GTX 970 asus and the disk contained in it was not in good condition also the seal was broken,now the online website is not replacing my product and saying that i have used the GPU and i should have returned it without using.
GPU is working fine tho' temps also don't go over 65c.
Anyways,after installing,there was a message regarding registration of product Online by ASUS,so that speaks for itself that this product is new?
Idk guys,need help...
 
Honestly as long as the GPU is behaving properly you should be fine. Be sure to register the product with ASUS in case you ever need to rely on the warranty for replacement, but beyond that you should be OK. Obviously it was either a re-stock or refurbished product.
 
Unfortunately, when you get a product with a broken seal you need to decide whether you will return it or use it before you take it out of the packaging. Most vendors will still let you do a like for like exchange, but they aren't really obligated to do that if you've installed it.

As others have mentioned, register it with Asus. They have good warranty and service.
 
Appreciate the response guys,i tried my best but seems that they don't want to replace it,honestly if GPU is working fine i'm satisfied.
I tried certain heavy games tho' with my 4670K and this refurbished/ New in old bag (idk) GPU and getting some good frames, Witcher 3 - min: 45 avg: 55 with NVIDIA hairworks turned off and all settings cranked up,any triple A game never goes below 40 fps and stays above 50 mostly which i think is fine....
 
Video cards get noisier at load, the sky is blue and water is wet.

Contact ASUS, get the registration information from them or at the very least get the date it was registered then contact the seller and give them hell and ask for some money back. Stay on this and feel free to be a jerk about it.

What has happened to you is extremely poor customer service.
 
Through ASUS i registered my product tommorow succesfully,giving them the purchase date info and seriel number,now this message that i've shown above pops everytime i start my PC,today i again tried to register the product,given same seriel number and everything but it says that this product is registered alreadywell,it's obvious as i've already registered this product succesfully,and nobody else's registered this product before me.

I did what i could,but these guys just keep saying sorry to me for all this ,which i don't need really,they can replace the disc and manual tho'...
I already sent a mail regarding this to ASUS yet no reply for now.
 
The whole you sold me a used item as new isn't having an effect?

Ask directly to be compensated if he declines ask for the manager and peruse it.

I would contact gov agencies and such but only because I hate being scammed. You might just want to confirm that the card is covered under warranty in your name then call it a day.
 
Under warranty section it's clearly mentioned by ASUS
Says,
"Asus guarantees that the Asus Graphic Card that you have purchased is free from defects in materials or workmanship under normal use during the Limited Warranty Period. The Limited Warranty Period starts from the date of purchase. Your sales receipt, showing the date of purchase, is your purchase date proof. You may be required by your Purchase Site or Asus Authorized Service Providers to present a proof of purchase as a condition of receiving warranty service. You are entitled to a hardware warranty service if a repair is required within the Limited Warranty Period.

During the Limited Warranty Period, Asus will, at its sole discretion, repair or replace any defective component. All spare-parts or module removed under this Limited Warranty become the property of Asus."

Well,i have registered the product already with my email address also have a copy of Invoice(reciept)of the product by my name with the purchase date as proof required by asus,as far as i know this product has 3 years of warranty from the purchase date,so if there is anything bad happens in this card,i can send it to ASUS with my copy of invoice.

 
Alright guys,they are replacing my GPU,but i have a fear whether the new card will work properly or not,as this card is performing as it should also temps are nice,so i just couldn't think of letting it go easily,i know i worry too much and only because this one is working perfectly,what you guys say?
