built in mic switch problem in the headset

My mic switch is having problems, it doesn't work when it's on or off but it records and works for a few seconds after I turn it either ways.
Too much resemblance of a spark generated from scratching stones
Help me out guys

Which headset is it?
Did the problem appear out of the box or after a view days, weeks, years?
