So I'm going to make a new build and it's going to be a Intel I5 6600k Gigabyte H170 Gaming 3 build and my current build is an AMD X4 860k With A Gigabyte FM2+ MB. Can I go ahead and swap out the CPU/MB with out a reinstall of windows 10 or do i need to delete the drivers.(I bought windows 10 not upgraded as i have seen people do with windows 7)

There is no 100% either way for a major hardware swap like that.
You may, or may not, need to reinstall.

For the OS licensing, read this: http://www.tomshardware.com/forum/id-3164428/windows-build-1607-activation.html
For the operation (booting up and running), maybe, maybe not. Prepare for if it does not boot up.

Most of the time you can switch out without having to do anything drastic like re-installing Windows. Reviewers do this all the time.

Of course you will need to install the appropriate motherboard drivers for the new board (sound, LAN, ect.).

My question is why bother with a K series CPU and an H series motherboard?

If you can boot, and that seems likely, then all you need to do is install the new drivers that come with your motherboard.

But... note that a H170 motherboard is a poor choice.
A cheaper H110 motherboard will do as well,
Or, you are leaving some 40% more cpu power on the table by not using a Z170 motherboard which will allow cpu overclocking.
