Can I upgrade to windows 10?

I am building a PC in a few weeks and am going to use my old CD key for windows 8.
Will I be able to upgrade this to 10?

Also does a hearing aid count as an assistive technology? I use one and it seems that people with assistive technologies can still upgrade

That is entirely between you and Microsoft. You'd have to ask them.
