Can Pirated Windows 8.1 update to Windows 10?

I have a friend (not a Toms Hardware user) who wants to upgrade to Windows 10. He has Windows 8.1 Pro from The Pirates Bay. Will his pirated Windows upgrade to Windows 10 and still work?

It will still be illegitimate. It wont magically become genuine.

You don't even need a current version of windows at all or any keys to get windows 10. If you want it you can download the media creation tool for free from Microsoft. Without a key though it won't be genuine as others have stated, and you'll have a giant watermark in the bottom right corner telling you so.
