code 43 in two brand new x99

Did an RMA. Evga support, forum member, and a friend all said the same thing, defective pci slot 1. Specs:
i7 5820k
crucial 2x4gb - 2400mhz
evga micro atx x99
evga gtx 970
rosewill 650w 80+ gold
Windows 8.1 x64 also tested on Win 7 x64

I have tested a gtx 560 in the first board and same code 43 but only in slot 1.
Also tested the 970 in an AMD board and it worked fine.
Both my cards work fine in slot 2 of the first x99 board.
Haven't bothered testing my 560 in the newer one, same error in slot one, again slot two works fine (slot 2 is limited to x8 I guess because of my 28 lane cpu?)

Nope. I was thinking of trying that. I'll do it now.

Then it might be a CPU issue. If RMA-ing it, check also the CPU socket for bent pins.

All the pins look good on both boards. I tried a software called "intel processor diagnostic tool 64 bit" and everything passed but I don't see anything about pci in it. I guess it's the cpu then
