At least until you realize that the Marvel characters are derivative
of earlier non-Marvel works, ie they're themselves guilty of what they
accuse the CoH players of.

Then someone should have sued Marvel :)

Mind you Intellectual Property is a very big field. Marvel is
likely suing over the *expression* of the idea and not the idea
itself.

Fair use doesn't apply here. I can tell you that without being a
lawyer and just by having read up on fair use and knowing what it
means which you seem not to.

Duffman in the Simpsons is completely different.

As I said before if you spend billions of dollars expressing an
idea then you will want to protect that expression since it
becomes in your interest to.

What do you care anyway? It's between Cryptic and Marvel.

I was kidding...Anyway, my point was:
a) these a private individuals infringing on TRADEMARK (maybe)
b) the private individuals aren't profiting, but CoH is...however, they
aren't profiting directly off the usage of said characters.

DC should sue the pants of marvel...hell, the Greeks and Romans should
sue the hell out of DC... ;-)

Because this is infringing on sanity. What is the point of suing
someone and pissing off your fanbase?

They don't have to win. They just have to ruin the private individuals
who don't do as they're told with legal fees.
