I have windows 10 installed on a 120GB solid state which I have just removed windows 8.1 from and want to merge the partitions but cant because I cant delete the old system partition which separates the unallocated disk space from the main partition.

if any1 is having the same issue CountMike's suggestion worked but I had to update the filesystem using diskpart, steps listed below; the os crashed once the volume was resized and needed to be booted in safe mode so I'd recommend using disk management to do the resize and it may make the diskpart unnecessary.
Open cmd - and ran the following
diskpart
DISKPART> list volume
DISKPART> select volume [x]
DISKPART> extend filesystem
