Could you put a Core i7-940XM in a lenovo t410 would it work. I am aware that the cooling may suffer as its a 35w to 55w tdp?

I could be wrong here but I'm pretty sure it would work but I wouldn't recommend it. The t410 has a PGA988 socket with the highest pre-configurable chip being the i7 620M. The i7 940XM uses the same socket time but it runs much hotter and will mostly like throttle or worse due to having a Tjunction of 100 degrees.

Thanks I noticed that one has a gpu the other does not so I would have no graphics. Unless I could fit one but I cant.

That too! The i7 940xm is a total beast though! I have one and run it overclocked to 3.1Ghz!
