CPU pin broken?

I have just received a new B360 B3H motherboard and after I looked into it a little I noticed this (see image, I am on mobile and I don't know a way to add a circle to highlight the pin but it's centered, I hope you can see it)

In images I saw online that slight gap doesnt exist.
Is it safe to assume that's a broken or missing pin?

That is definitely a damaged pin. Return or RMA.

Doesn't look broken. Just a bent pin.
You might be able to straighten it. Just need a lot of patience.

So, the vendor I bought this motherboard from told me this is not covered by the warranty which is pretty * seeing as this was not my doing.

I did send an email to Gigabyte in hopes that they will have a different answer.

Do you guys know of any other way I could look into to pressure them into replacing it?

You don't need to pressure them. My guess is they will offer to RMA the motherboard, just for good customer relations.

if the mb is new and under 30 days and you used a credit card file a charge back.

Thats definitely a bent pin.
If sold "as new", that is 100% covered.
