CPU won't throttle down

I just finished my itx build today with a 4790 and Gigabyte H97n-Wifi. It's running well but the CPU is running at a constant 4.0ghz even with speedstep enabled in the bios, any ideas? (CPU utilization is 0-10% at idle).

it could be you have your power settings on performance
