Crime and unven punishment

In this story linked below is about a driver who looked down at an incoming text message who ran off the road as he claims(I drive by there everyday and there is no way in hell he just "looked at a message." It looks as though he was responding to one and then the accident happened. He ended up killing two fisherman and severely injuring another. His sentence: 120 hours of community service, $1000 fine and loss of his drivers License for 10 years

Here is another story below of where two scumbags dragged a police officer a short distance then the officer fell off thereby getting injured.

I think the perps if caught in the second story will have a harsher sentence than the guy who killed the two fisherman.


Sorry killing two innocent accident or not due to wrecklessness SHOULD BE A STIFFER PENALTY!

P.S. NEVER take what you read in press/media on face value... they are not there to inform and educate.. they are there to sensationalise to maximise eyeballs/profit.
 
As the second case is yet to be tried, you can't assume what the outcome will be (but you are likely correct).

The first case, while tragic, only reflects the laws on the books that must be adhered to. The driver likely had a relatively clean record, had no drugs/alcohol in his system, and had a decent defense attorney to advise him on the least painful path forward.

Two men died needlessly, of that there is no doubt. I agree that some significant jail time is warranted (vehicular manslaughter?).

However, it appears that the judge accepted a plea deal where the driver pleaded guilty to a civil traffic violation, one of the lowest rungs on the ladder of penalties. Acceptance of the plea forced the relatively light verdict.

This section of the forum is for these sorts of discussions. There is long history of such dialogue on Tom's Forums with such topics.

The takeaway from this is that us geeks think about more stuff than just tech. Just something to consider.
 


Respectfully, This is news and I'm trying to hear what the peanut gallery has to say. The first perp got off with a slap on the hand, two people are dead, one will have life long injuries. I have a a close connection to one of the families that lost a one, brother and good guy all around........Yeah and I'm pissed! The second , when caught will get buried under the courthouse..........My issue is the punishment inequality.
This is not sensationalism, this is news as the title of the forum implies. Why the bad vibes?
 


I live in podunk Brevard county and if there ever was a place to document how the connected get away with everything in America, here would be a good starting point. Years back a commissioner's son hit and ran, killed a pedestrian. His sentence? No Jail time, WTF?
 


Years of experience..
Seen way to many media stories.. leading people to think one way.. and not giving a balanced picture. From the story - you/we know nothing about the real circumstances.. so unless you really delve into the story.. and read the court transcripts etc.. you never get even a glimpse of the true picture.. even from "reputable" media outlets.
Which means your links... from a single source.. of questionable veracity.. are just not worthy of comment. and just likely to precipitate ill-informed "debate".

And I guess that is what I am really frustrated about.. not you per se.... but the really poor service we get from media organisations and the subsequent poor quality of the debate.

So Sorry that you you were the one to pick up my frustration 🙁
And even more sorry that you we touched personally by the tragedy.

A few months ago, I was the victim of a texting driver.

Her action:
At least 10 seconds of not looking out the window at the red light in front of her.

My result:
Hanging upside down from the seatbelt in my truck.

Small sedan, hitting broadside and causing a fullsize pickup to roll over....sedan driver was going at least 50MPH.
10 seconds @ 50mph = at least 3 football fields of no one actually driving the car.

As it was already illegal for her to be doing that (in this state, under 18 means no phone, no text, etc)...I'm not sure what else can be done.
It was illegal, she knew it was illegal....and still she did it. My truck was totaled, and a too-small check from her insurance company.

Meanwhile, her car...being 'newer'...wasn't quite totaled, and got fixed. I had to take the settlement check and buy something even crappier.

Luckily, I am still vertical and breathing. Far too many aren't as a result of this stupidness.

Hang up and drive the damn car.
 
Our court system is no longer uniform in sentencing. Case law has become too much and too many judges are handing out what they want. You get everyone's different opinion.

For example, two counties where I live. If you get caught in one, you get out of everything. Lots of drugs and crime there because the justice system lacks the teeth and claws. Penalties are light. In a neighboring county, they're very strict and everyone comes out on the losing end. Crime is low and drug use is not as rampant.

In the end it's all about how much money will they make. If they locked that kid up for killing people, he wouldn't have means to pay his hefty fines. The other guy has no means to pay his fines, so they'll probably lock him up.
 

+1, brudda, on both counts (being vertical and your sentiment). Seems I dodge more and more distracted drivers on a daily basis.
 


All is good my friend. I must admit I'm too close for an object POV. I have seen one family's lives turned upside down from this injustice (from my view).
I'm sick of how in my county, those that are connected take advantage of how punishment is not evenly distributed. The Good Ole Boys hard at work here in Breevard County, Fla..

No argument that money/influence, etc can affect a legal outcome. None whatsoever. And, I think most would agree that money/influence, etc should not be a factor.

But, what country does it any better (this is truly a rhetorical question BTW)?

Not so sure about that. The "ASBO" concept over there worries me a little bit. A touch of 'thoughtcrime', it seems.
(and yes, I've spent a LOT of time in the UK. Was married to a Brit for many years)
 


LOL.. don't go there.. Lawmaking is a political thing.. and yes - we have some bad laws.. but I think US it still much worse... (to even get close to SOPA?)
"justice system" is the implementation of those laws - and UK (although far from perfect) is IMHO MUCH better in this regard that US.. far better separation of Judiciary from political structures,, and much more consistency (though we are a smaller country.. but even taking that into consideration).
