I currently purchased Crysis with my friend our systems are...

MINE:
MSI k9a2 Platinum Mobo
AMD Athlon x2 6000+ (oc'd to 6600)
4gb(2x2gb) Mushkin 5-5-5-18 DDR2 800 RAM
Visiontek 4870 (oc'd to 780/1080)
Vista Premium 64bit
500gb Hitachi Deskstar 7200rpm HDD

HIS:
Foxconn A7DA-S Mobo
Amd Phenom 9950BE (stock)
3gb(3x1gb) Patriot 5-5-5-15 DDR2 800 RAM
Evga 8800GT Superclocked Edition
Vista Premium
Seagate Barracude 320Gb 7200rpm HDD

Now obviously his processor betters mine, but my graphics and the additional 1gb of ram should run Crysis more smoothly Right?

well i thought so.. but he is able to run 1280x1024 at "very high" settings except shaders and Postprocessing are set at high and he gets 30-40fps.

I can only run 1280x1024 all High except shaders on Medium at 22ish-35fps average....

So im confused i thought upgrading from a 9600gt to a 4870 would give me mostly very high like my friends, becuase i was getting 25-30fps on medium and water on high with all the same except components and just exchanged my graphics card....

ALSO my 3dmark06 score is only 12,100 is this low for my setup, considering what i have overclocked? i thought i could get 13-14000...

im just a little disappointed and confused... any suggestions?
Catalyst Drivers are 8.9 all Vista updates installed

The problem is ATI has terrible drivers for Crysis on the 4850/4870... it's built around nvidia. Your CPU is pretty bad for Crysis too.

12,100 3Dmark06 is actually pretty damn good for one 4870... In fact, it makes no sense, because 3 GTX 280s score around 23,000.
Get crysis warhead, it's much better optimized for people who dont have $5k PCs (everyone except me and like 5 people :D )

I dont think this has anything to do with the ATI drivers, because when people review the card its getting excellent fps (better than the GTX260)....
- i forgot to mention my friends 3dmark06 was 12800, does a quad processor make that much of a difference? i was told and from what i read Crysis is GPU dependant not CPU, so athlon x2 oc'd to 6600+ should be good for crysis no?

Yes, but the 4850 is competing with the gtx260, and the 4870 with the gtx 280, and the gtx 280 is better than the 4870 by about 10%. 3dmark06 has only to do with your GPU I believe. Crysis is GPU dependent, but if you were to run a bad CPU, you would still get a 5-15 snag in fps, whereas in a game like world in conflict, it would be unplayable if you had anything worse than a 3ghz dual core. Your cpu and gpu should be running crysis on high with 10-25 fps, and medium with 25-40 (thats with no AA/AF and DX9).

Actually, at that low resolution, you're definitely not getting the fps you should. Check if you have some other CPU/RAM-intensive programs running, and again, I think it's the drivers.

Your saying i should run crysis on medium? i was getting 30ish fps with the same cpu and a geforce 9600gt.. that isn't right, plus my friends 8800gt runs his on mostly very high, so this isn't supporting your thesis... i think it may be the proccessor indeed bottlenecking my system, but i have heard of people running a amd 5000+ with a high end graphics card getting high settings easy, so im not sure im ready to render my cpu being the problem... mabey there is something more to it.. i run it in Dx10, its installed in the Program Files 64bit folder... would it be better to fun it in the 32 bit Program folder possibly?
