I'm sure he does...it would be nice though, for the sake of promoting competition and helping prices go down.

Non-compete agreements are automatically void as a matter of law in California, except for a small set of specific situations expressly authorized by statute. They were outlawed by the original California Civil Code in 1872. So because AMD corporate HQ is in California and Intel is in California there is nothing legally stopping him from going to AMD.
