deleted file overwritten by folders?

this might be a stupid question, but do folders overwrite deleted files?

i was trying to restore formatted files with a program, but it created folders in the hdd that i wanted to restore.

If you're trying to recover deleted filed from a HDD, then you should to recover them to a different drive. Anything you write to that drive could overwrite the deleted files.

i know that, but for some reason the program created folders in the hdd and i didn't even hit the recovery button.
do i risk data loss because of these folders (there empty/ no files in them)
