Question Diagnosing a possible "bad" 3070?

I few months ago I got a 3070 (EVGA FTW) to replace my 1080. Ever since I got it, the performance just seems...off. I find that I got better performance with my 1080 in games I've played on both cards. Especially I feel that even when games are running at 50-60fps (1440p) they feel very choppy. In addition, games that should run very well don't seem to. Case in point, Elex 2, which should not be a demanding game, is running at high 40s and mid 50s and doesn't feel smooth at all, even with Gsync.

I completely rebuilt my computer at the time so it could be multiple things, but I think I have to start with this card. What can I do to figure out if this card is bad? It still runs games, is able to use ray tracing and DLSS, but it just seems to be working very poorly. When I ran it 3dmark with it it was one of the very bottom cards ranked.

I ran userbenchmark to start. Any help is appreciated.

the RTX 3000 series uses some more advanced technologies than the GTX 1000.
have you run DDU in Windows Safe Mode to remove the previous card's data and freshly installed the latest driver package directly from Nvidia?
if not, there's a chance that the 3070 is not being used to it's full potential if settings/drivers are still optimized for a 1080.

it actually is a more demanding game.
many have been complaining that they aren't getting the performance they had anticipated.

I actually did a fresh install of windows on a new ssd just recently so there shouldn’t be anything old there but I’m willing to try anything.

I suppose a better example is Sea of Thieves, which ran flawlessly on my 1080, has noticeable drops below 60fps now, same with Forza Horizon, and with RT features off. Elden Ring also has a lot of problems, especially when it rains, but that game has its own problems.
