Do the 965P-DS3 boards still have AHCI/NCQ issues?

I don't use RAID but I believe I'll be using AHCI. I've read over and over again that this board has problems with those 2 specific SATA inputs, has GA released a BIOs that has this fixed?

Its not so much the MB as it is Intel's ICH8, JMicron controller, and WinXP not playing nice. You can use both and IDE and an ACHI SATA drive on the JMictron port on the P965-D3S boards but you need to install the drivers in a certain order.
