NO, the dots should not work.

There was an uber-dot gun sometime back that kept working at 1/1. The
devs responded by saying, "Uber-guns are okay because they decay and
eventually leave the game. 1/1 guns should not work." They then
corrected that problem.

Yes the dot will work even if the items is broken.
