The Librarian of Congress is able to propose exceptions to the DMCA because Congress couldn’t foresee all the unintended consequences when it passed the DMCA. The Librarian of Congress has exercised its right over the past few years to add exceptions to the DMCA, such as the previous exception that made it legal for consumers to unlock their smartphones and for tractor owners to repair their purchased vehicles.
Oh I'm fairly sure that the big media cartels were counting on these "unforeseen consequences" as it meant more money in their pockets. Its one reason they've lead the push on you don't own jack when it comes to software and firmware... and the modifications of EULAs to reflect the revised claim of ownership.

Apple has really ticked me off recently by locking firmware on Macs and MacBook Pros I've paid good money for at legitimate university auctions.
