Earthshock vs Patagia

OK, another silly question:

A Nosferatu has Patagia, and is in combat with a vampire with Potence.
The Potence vampire strikes Earthshock.
If the Nosferatu burns a blood to gain flight after that strike is declared
does he avoid the effect of Earthshock?

A strike's legality is determined when it is declared. A strike's
effectiveness is determined when it resolves. The question then, is
whether "not usable against a minion with flight" is a statement of
legality or effectiveness. I'm about 90% sure that it's legality. You
cannot play it if the other minion has flight, but if the other minion
gainst flight and Earthshock resolves, it should do full damage.

The Earth explodes due to the shock of it all.
