Everytime I attempt to overclock, keeps saying overclock failed?

I am trying to overclock my 8350 to 4.4 ghz - as I have been able to do on my old 760g chipset motherboard. I went from an ASUS M5A78L-M/USB3 to a Gigabyte 970a-ds3p, everytime I try to overclock in the BIOS, it hits me up with a Overclock Configuration Failed, and the current speed of the CPU appears to be 0 Mhz. Is there a fix for this? Thanks.

you just jump for no oc to 4.4?
