There is no way to know with your pictures. The only way to guarantee no ripoff is to buy new from a reputable retailer. You are buying used. There are no guarantees.

I agree with Kanewolf, unless your present when card is plugged in and showing on boots as what it is, you could bee dealing with a fake.
if an auction a high rated dealer will provide some reality on their quality of their auction.

The only way to know is to test it. People can flash it to appear a different gpu. If it's performs way lower than it should then you have a card with an issue.
