That was false. Everyone can upgrade. But if you did not have a valid Windows license to start with, unless you were in the Insider program before Microsoft cut it off a few weeks ago, you still will not end up with a valid windows license.
But all of that will most likely be a moot point in a year or two anyways. It seems that this Free Windows 10 offer was not only to get people to take a new license, but to then later on, when they buy or build a new computer, to make them sign up with a Subscription fee to use Windows. They are not saying anything about this right now. Mainly because they know if they were to say it right now, everyone and their best friends would be back on Windows 7 or 8 faster than you could say ZOOOOOM! but watch what happens in a year.. Maybe 2.
