Folks, take good care of your Flight Sim 2004 disk four
(the one that must be in your computer to run). Should it
be damaged so that you can not reliably start the program
it'll cost you $30.00 for a replacement set.

Microsoft can't or won't provide replacements for just
Disk 4. And, of course, it's copy protected.

Here's your solution. Download and install in the main FS9
folder, overwrite any files.

That's simply not true, regardlesss of what MS says one
can legally make backup copies of their software as long
as you are not making many copies or sharing!

crvm,

you should re-read my previous post.

i didn't write that it's not true
according to microsoft it is legal to make a second copy for personal use.
read last sentence :
" If not prevented by copy protection technology, the primary user of the
COMPUTER on which the SOFTWARE PRODUCT is installed may make a second copy
for his or her exclusive and personal noncommercial use on a portable
computer."

if you had read the above from previous post,my interpretation is , that
even microsoft states it is legal for personal use.

please read posts thoroughly before posting negative comments.
if you don't agree, then post a fix , or something that may help.

Hey me -

I think this bozo's a troll. He's posted twice, stating that the prior post
was "wrong". He sounds like a 9 year old who hasn't a clue.

Interesting aside - talked to a few attorneys about the " If not prevented
by copy protection....." line. My question was - If one could circumvent
the copy protection and then make a copy, would that be legal? Typical
attorneys gave me nebulous answers <g> but the consensus seemed to be "yes
it would be legal". The opposition maintained that the meaning of the
statement is " If it's copy protected, you are NOT allowed to make a copy".

BTW, for those reading this - there is no LAW that states that you CAN make
a copy for your personal use. It's generally accepted, and I do it all the
time but a few people have said that the LAW says you can - according to my
attorney friends there is no such LAW either express or implied..

IANAL, so I'm just passing on info. :)

Circumventing the copy protection is a violation of your contract.
So while you may LEGALLY circumvent the copy protection and not be
prosecuted for making that backup copy (which you of course store in the
home of a friend who solemnly swears to not use it, cough cough), you will
be in violation of your contract which voids your license to use the
product.
You will therefore replace a criminal charge with a civil one, which may
prevent you time in prison but leave you open to litigation.

Hi Jeroen -

Playing the devil's advocate if I may ( because I agree with you in
principle ) - Can you CITE where it states that circumventing the copy
protection is a violation of your contract? IANAL but the mere fact that it
IS copy protected does not imply that it is a violation to defeat that
protection. So, is there a paragraph that specifically states that you
cannot bypass the protection else you are in violation?

Thanx,

Vic

"Applications Software. You may only install, access, and run ("RUN") one
copy of the SOFTWARE PRODUCT, or any prior version of the SOFTWARE PRODUCT
for the same operating system, on a single personal computer, ("COMPUTER")
for your personal, noncommercial use. If not prevented by copy protection
technology, the primary user of the COMPUTER on which the SOFTWARE PRODUCT
is installed may make a second copy for his or her exclusive and personal
noncommercial use on a portable computer."

"Termination. Without prejudice to any other rights, Microsoft may terminate
this EULA if you fail to comply with the terms and conditions of this EULA.
In such event, you must destroy all copies of the SOFTWARE PRODUCT and all
of its component parts."

"COPY PROTECTION. The SOFTWARE PRODUCT may require the original media for
use of the SOFTWARE PRODUCT on the COMPUTER and/or employ copy protection
technology to prevent the unauthorized copying of the SOFTWARE PRODUCT. It
is illegal to make unauthorized copies of the SOFTWARE PRODUCT or circumvent
any copy protection technology employed in the SOFTWARE PRODUCT. "

There's also restrictions against devices and software to defeat copy
protection technology in the United State's Digital Millenium Copyright Act
(DMCA). "Fair use" isn't mentioned in the US constitution, was probably a
part of an earlier act of congress and would be subject to revision by more
recent acts of congress including DMCA. A federal appeals court recently
ordered a DVD copy program recalled for these very reasons.

Thanx, Robert. I assume that's from MS Flight Sim EULA or just their
generic?

If that's the case then, it is illegal to make a copy of copy protected
software even for YOUR OWN USE. Period.
