Question Gigabyte Eagle OC RTX 3070 low fps and stutters

Hello guys. I bought a brand new gaming rig
Specs:
CPU: intel i5 12400f
Mobo: Asus Prime z690- P-D4
GPU : Gigabyte Eagle OC RTX 3070
RAM: 16 gb ddr4 3200mhz
PSU: Coolermaster Silentpro 800W Gold

Apparently my gaming pc performs lower than expected. I'm having low fps in games (Spiderman Remastered, Call of Duty Modern Warfare II) with high/ultra graphic settings @1080p.
I'm monitoring the gpu usage and power consumption and the gpu usage is around %70-85 in CoD MW2 multiplayer. While playing Spiderman Remastered, the fps drops to 58 when fighting against enemies. GPU usage is around %50-56 while cpu usage is %70. All temps are ok. Gpu temp is 59 celcius. But the gpu draws way less power from the psu than it should be. It produces 118 watts maximum in Spiderman. In CoD MW2 the watt sometimes reaches to 128 but never reaches 200.
Average fps is 75-80 in DMZ mode and the game stutters and lags like hell. Allways having fps drops and sometimes gpu usage drops to %20 and this causing big stutter spikes. In normal games modes such as team deathmatch and domination, fps is around 95-105 so I'm okay with that but in DMZ mode its unplayable.
I'm really desperate and dont know what to do really.
My pc isnt performing normally and having low fps in 1080p . Should I send it to warranty? Thx for reading

brand and model of the psu?
what the storage? how full it is?
malware scan the system?
PSU: Coolermaster Silentpro 800W Gold
I have 500 gb samsung 980 evo nvme ssd. It has 73 GBs of free space.
I scanned my system using windows defender (offline scan). And It removed a program I once installed (GOM Player). I've had already uninstalled it a month ago but there was some trace of it .

Those symptoms sound an awful lot like VRAM overflow. The RTX 3070 only has 8GB of VRAM and it can overflow even at 1080p if you're using ray-tracing. Try these possible fixes out:
  1. Disable Ray-Tracing
  2. Reduce texture quality
  3. Turn on DLSS
You can also monitor your VRAM usage with an on-screen overlay like MSi Afterburner's RIVA Tuner.

i suggest you to change the gpu witha 12g-vram one like 3060 or 6700xt
i have this experience that vram is at a shortage in ultra mode of new games

I'm monitoring the VRAM usage it never reaches 8GB in total but it mostly stays at 7200MBs. I'm not using Ray-Tracing and DLSS is enabled , on quality mode.
