Question GPU Fan 1 spinning over 100% at high temps

My PC Setup
CPU: 9800 x3D
GPU: Gigabyte Aorus 5090 Master
MOBO: MSI MAG Tomahawk x870e
RAM: 64 GB

When my PC is hitting above 83c my GPU Fan #1 is breaking fan control's setting and going well above 3000rpm otherwise it works just fine. At first I thought it was GPU sag, but I vertically mounted it and its still doing the same thing. Any ideas welcome, thank you.

It might have something to do with the hot spot reading Nvidia did away with on the 50-series...
On older generations, if hot spot reached 100C+, thermal protection would kick in and any fan curves would be ignored for the sake of trying to cool the GPU down.

Can't say for sure if that's the same thing happening here.
May need to fix case cooling(if possible), or RMA the GPU.
