GTX 1070 fps problems

Hello.
about 2 months ago I bought my new build with Inno 3d GTX 1070.
A few weeks ago I encountered a problem.
suddenly,in the witcher 3 the fps in the main screen lowered from 2500 fps to arund 90 fps,and in game in novigrad the fps was low as 25(changed the graphics settings,no improvment).in heaven benchmark 4 on max settings instead of 90.5 it got 89.5 fps.then I try to reinstall the previous driver (368.69) and it worked fine,for 4 days. then I tried to install driver 368.39- same problem).
Contacted the warrenty and they told me its a software issue and i should format my pc.
I formatted it,worked like a charm,and then yesterday the problem returned.the fps is now around 1500 on the main screen but in game it works just fine,i think even better(updated driver to 372.70) around 55 to 75 on max settings in novigrad (1080p).
Tried heaven benchmark again,the result was around 88.5 to 89.
It's not a huge diffrence,but I fear that the fps will drop again,and all of my games will be unplayeble again.
I don't think(and I hope so ) that this is a hardware problem,after a format of windows 10 it worked fine and then the problem started again.
I think is a problem in windows 10,but many people don't encounter such problems.
What do you think is the problem?
my specs:
intel i5 6500 stock clock
gtx 1070 inno 3d stock clock
8 gb ram
windows 10 64 bit pro(download from a torrent form the pirate bay,maybe thats the problem?,its not activated)
Also one month ago a power shutdown happened while my pc was awake,afterwards there was 2 times before the problem i described that the fps was very low (around 15 to 20) but a restart fixed the problem
Please help!

 
It's probably a driver issue combined with win 10, give it a couple months and they'll probably have a more solid driver, in the mean time check your windows updates and see if you're up to date.
 


I know they will fix it eventually. But right now other people enjoy playing with very high FPS and always fear the problem will return again.
