I'd go with the 970 build. You are going to see alot more performance with a 970 vs a 960 then you will a 4770k vs a 4790k.

Depends on the ratio. If you will be doing more gaming get the 970, if you will be doing more video editing go with the 4790k.
Also I would recommend a 1060 instead of a 970 should you pick the gaming route. It performs better and costs about the same.

There isn't a reason in the world to pick the second build under any circumstances.

The only advantage of getting a GTX960 is the lower power draw and resulting heat. The GTX 970 is much faster and will take a less noticeable performance hit when streaming using the Nvidia encoding tool (don't remember the name). On the other hand you will only notice the difference of 4770k vs the 4790k in bencmarks.

To sum it up:
- if you value fast graphics and high quality settings, as most gamers do, get the GTX970 + 4770k;
- if you value quiet and low power PC with a more powerful CPU (as i did with mine GTX960 + 4690k), get the GTX960 + 4790k.

As I mentioned, there is no reason to get the second build, the 4770k can overclock to any speed that can be achieved with he 4790
