Harddrive Failure After Win10 Upgrade - Options?

I upgraded Win7 to Win10 via the invite and now I need to replace my harddrive (unrelated incident). Is it possible for me to reinstall Win10 on the new drive and stay legal or am I stuck with purchasing a retail copy?
