My headphones only work in both ears if the jack is slightly unplugged. Like I plug the jack into the headphone/microphone splitter (that came with the headphones) all the way and it only works in one ear. To get both cups to play sound I have to pull the jack out ever so slightly.

Are my headphones faulty. They are brand new Asus Cerberus ROG Gaming Headphones.

Sounds more like splitter is faulty or the female part in the computer. Of course the easiest way would be to try other headphones first...
Your headphones does not get contact inside the female part of the socket. If the headphones would be the problem, then you would not get sound to both ears in any position.
Normal stereaplug is divided to 3 parts and each of those has counter contact part. To get a sound you need contact in each section.

So the socket is the my primary suspect in this case.
