Oh ok. I just OC'ed to 4.2 and I ran intel burn test and my core temps got to a 79-85 max temp but it finished the whole test. Are these good temps to max out at when running this test?
 

I'm using an aftermarket cooler, Hyper Evo 212. Although I do recall that when I applied the thermal paste I used the pellet method and it seemed to be more on the left side of the cpu when I applied it so could that be the problem? Do I just need to reapply the thermal paste?

If your ok with 85 max load under stress test then you are likely fine you will most likely see 60 or 65 degrees in games anyway. Even 85 degrees would only be bad if it were for extended periods of time. Haswells max design temperature is somewhere in the 90 to 110 degree range.

If the CPU is new, give it some time to "Burn in" my 4770k cooled off by 10 degrees at my 4.2 ghz oc over the first week I ran it.

Exactly, You have 3 options:
-Buy new Procie and dump the old one
-Return to sender(intel)
-DIY paste (a bit hard, and it voids your warranty, but you can apply the best paste on the die
