Kill Baal and exit go through that portal that opens then. When you start
the next game, you will be asked which difficulty you like to play.

My Amazon is at L35, normal. My Pal is L29, at Act 3, NM. He never did or
could kill Baal. He wouldn't last more than 2 sec. at Arreat Summit and I
would have remember that. So how did he get to NM?

Is he a 'classic' version? That would be the only way a character would be
in NM without killing Baal.

afterwards upgraded to LOD, so now he's exp. char. in Night. without killing
Baal.

That's what happened. My Pal, I upgraded when I got LOD and my Amazon was
created later. I just killed Baal about an hour ago, so now I'm at NM, Act
1.
Now it seems too easy, even at /players 8

A character that killed Diablo in Classic can enter NM without killing Baal.
Also you only have to kill Baal, you don't have to actually enter the
Portal. If you save and exit it still sends you through. I know this because
there have been times that i have killed Baal too close to the edge and the
Portal has opened in mid-air making it Impossible to enter.

Did you play the pal at pre-LOD times?
If you killed Diablo (=ability to play NM) then converted later to
Expansion-Pack!!
Otherwise it is only possible if you played your SP in open bnet
