I have Windows 7 installed on my HDD, do I have to transfer it over to my SSD before I can install Windows 10 on my SSD? Or can I do a complete fresh install onto my brand new SSD straight from the disk that I burned for Windows 10?

Solution
You need to activate the free Windows 10 upgrade at least once by upgrading a previous Windows 7 or Windows 8.1 install. Once you do that you may be able to reinstall Windows 10 on the new harddrive, just click next on any product key pages. This hasn't been tested by many yet though.

I have legitimate windows 7 with a product key so can I install it straight to my SSD?
