hyper 212 evo serious problem

I had build a new pc and bought a 212 evo aftermaket cooler. The problem is that the cooler dosent sit well on my gigabyte h97 motherboard.

the problem is that sometimes the pc wont boot and in windows is lagging as hell and cpu usage spikes up even in idle. the solution i found was to push from the bottom to top like this

I took out the sistem from the case and place them on my table and even on a flat surface its the same problem. So eventualy i unscrew the X bracket holding down the cooler and the problem seems fixed. I cant understand whats the problem with the X bracket, i didnt tightned the screws to maximum length, any fix is apreaciated
 
Firstly, I would turn it 180 degrees so the fan is pulling through the heatsink.

Did you tighten the screws evenly? did you do a bit at a time (on each screw) or tighten one all the way then moved onto the next one?
 
the backplate cooler bracket on the back of the motherboard is the corect one installed. all 4 cpu standoffs are installed corectly. the problem is only when i try to install the X bracket with the 4 screws.

the screws are evenly installed using the star method . i think i installed the cpu more than 5 times till i found the problem.

what about the screw in the middle of the X bracket? should it be tigtned or more loose?


 
like i said, with only the cooler and no X bracket installed the pc works normal so reseating the cpu will do nothing, but i did reseated it a few times till i figured out what the problem was.
