Hyper 212 heat pipes bent?

So, I recently recieved my new hyper 212 Evo in the mail today. I go to install the cool but when I lay it on top of my CPU, the heat sink doesn't lay properly on top of my CPU without the actual cooler being titled. Is it supposed to be like this or is this damage from shipping or a defect?

while i haven't used the 212 evo, i would say it shouldn't be like that. it won't affect performance as long as the plate that actually contacts the CPU is flat still. You could try to RMA it, may not be worth your time though.
