yes, you should revisit all aspects of it's cooling, ventilation, cleanliness (absence of dust, cobwebs, pet hair, gander and dandruff) , and airflow.

Yes (+2). At that temp, I would first check the contact between your cooler and the CPU. Must be loose, or thermal paste is too thick. Also, confirm that the fans are turning.

-What cooler are you using?

-Does your case get noticeably warm when the CPU is that hot? (suggests you need more ventilation)

You might try a more aggressive fan profile in bios.

i am using a Raijintek RHEA 3Pcs 6mm Heat-Pipe, 9225 PWM Fan. and yes, when i am next to it, it gets warm. i had to take the side off in order to keep the system cool. i have a Zotac GTX 970 amp extreme core edition graphics card that runs at 60 cel when gaming. it also has all five fans running at full speed, which is at 2500+ RPM as well as the heatsink fan at 2000+ rpm

If your case is getting warm, you could benefit from improving case airflow. You can have the best cooler in the world, but if it's recycling hot air, your CPU will run hot.

What case? Over 90 on a regular basis will reduce CPU life-span.

Did you overclock this CPU? How did you measure it?
What's your ambient temperature?

Is your bios of your motherboard up to date? Which motherboard is it? Which bios version?

No, i did not overclock. It is fast enough without it. As for the BIOS, i updated it, but i will look again. It sits at 30 Cel when idle.

Yes. i did fix it. It was bad monitoring software. It runs about 78 cel when under max. I did remove the heatsink and reapply thermal grease. I spent 5 months and 1500 to build this thing. I'm going to leave the side off as it runs 87 with it on.

Is it a freshly installed windows with this hardware or did another CPU run with it?

Is the cpu cooler really installed correctly?

78 is still too much

Depends what they mean by Max. That cooler on Prime95 could easily reach 78C when properly installed in a well organized case.
