I think my GPU is broken

Basically built a new system yesterday. Everything in the system is brand new other than the graphics card which i bough on ebay from a very respected seller. When running games most of the time its fine and performs as you would expect (its a GTX 780ti btw) however when i close the game the screen freezes, my pc crashes and i get blue and green squares, im guessing they're artefacts however theres no apparent reason for it. The card never goes above 65 degrees, ive down-clocked both the memory and processor by 50Mhz, increased the max wattage allowed to the GPU and basically thrown my fans up to full and that gave a solid 3 hours in game and then when i exit it crashes yet again. Basically i want to know if i should be sending this back to the seller which is real hassle and i bought it nearly a month ago so i dont know if i can with it being ebay. Or is it an error on my part? if so how do i fix it?
 
I have checked that everything is compatible and it works fine if i dont launch a game and just use other programs. There are only two things i can think that may cause the issue and thats it compatibility with Windows 10 or if i try a different cable and see if its the DVI display port. however i dont know if these would effect it
 


so i tried installing a fresh OS, this time using windows 7 and i have tried every fix i can find on the internet. This included trying different PCI slots and using different cables and i still get crashes. I have narrowed it down and it seems that the system crashes not when i am in a game but as soon as i exit, its crashing when the GPU load goes from a high percentage to a low percentage. I tried underclocking the gpu using afterburner which makes it more stable in game however it still crashes when i exit. It also occasionally stops the output of the graphics card but the PC stays on as if its running normally with no output. Any other suggestions?
